Continued Appeal Hearing - Knife River Conditional Use

Notice is hereby given that the Crook County Court will hold a continued Public Hearing at 9:00 a.m.  Wednesday, June 15, 2022, in the Crook County Meeting Room, 320 NE Court Street, Prineville, Oregon, to consider the following:

 

Record Number: 217-22-000540-PLNG - An appeal to the Crook County Court by Knife River Corporation (Applicant/Appellant) of the Planning Commission denial (217-21-000573-PLNG) of the request of a conditional use approval for aggregate mining operations on the property. The Applicant proposes phasing in mining to allow continued use of the property for agricultural production. The site will be reclaimed for agricultural use. The subject property is identified as Township 14 South, Range 15 East, WM, Section 14, tax lot 103.  The property is zoned Exclusive Farm Use – Prineville Valley and Lone Pine Areas (EFU-2) and is located at the corner of Stahancyk Lane and Lamonta Road.

 

The appeal is subject to review under Crook County Code, Title 18, Chapters 18.172 (administration provisions), 18.16 (conditional uses in exclusive farm use zones); 18.160 (conditional uses), 18.144 (Aggregate Resource sites), Crook County Comprehensive Plan, Oregon Administrative Rules and Oregon Revised Statutes.

 

The grounds for the appeal, as stated by the Appellant, are that the Planning Commission’s finding that the applicant failed to demonstrate consistency with CCC 18.160.020(2) is conclusory and neglects to acknowledge substantial evidence in the record which demonstrates consistency with Ordinance 328 and applicable provisions of the County Code.

 

A notice of public hearing was published at least 10 days prior to the County Court’s first appeal hearing on June 1, 2022. This notice of the continued hearing is provided as a courtesy. A copy of the staff report is currently available for inspection at no cost.

The hearing is being held pursuant to Crook County Code Title 18, Section 18.172.110.  The hearing before the County Court shall be confined to the record of the proceedings below, as more specifically set forth in Crook County Code Section 18.172.110(12)(a).
